Abstract

Temasek dalam pembelian saham Indosat dan Telkomsel telah melakukan cross ownership, sehingga Temasek dapat dikatakan memiliki posisi dominan yang dilarang oleh UU Persaingan Usaha. Dengan demikian, dapat memberikan pelajaran bagi pelaku usaha yang akan melakukan pembelian saham terkait dengan ketentuan persaingan usaha. Implikasi terhadap pembelian saham tersebut dapat mengakibatkan kerugian bagi konsumen. Tindakan pelepasan saham dari salah satu perusahaan, justru kedua perusahaan itu menjadi sehat.

Temasek in purchasing of share of Indosat and of Telkomsel have conducted ownership cross, so that Temasek can be told to have dominant position which prohibited by Antitrust Act. Thereby, can give Iesson to perpetrator of business to do purchasing of share related to rule of antitrust. Implication to purchasing of share of teresebut can result loss to consumer. Action release of share from one of the company, exactly both that company become healthyly.
