PERTANGGUNGJAWABAN TELLER BANK AKIBAT TERJADINYA KESALAHAN TERHADAP TRANSFER DANA NASABAH

Proses transfer dana dapat dilakukan secara tertulis, dan salah satunya melalui teller bank. Proses transfer dana ini tidak selalu berlangsung dengan baik, adakalanya muncul suatu permasalahan mengenai kekeliruan, dan lain sebagainya. Oleh karenanya perlu dicari metode penyelesaian atas kejadian tersebut, yang mana menjadi inti rumusan masalah dalam penelitian ini. Penelitian ini merupakan penelitian normatif. Hasil yang didapatkan dari penelitian ini, yaitu teller bank harus bertanggung jawab atas kekeliruan dalam pelaksanaan transfer dana. Dalam hal terjadi keterlambatan atau kesalahan transfer dana, yang kemudian menimbulkan kerugian pada Pengirim atau Penerima, maka pihak penyelenggara dan/atau pihak lain yang mengendalikan sistem transfer dana tersebut dibebani kewajiban untuk membuktikan ada atau tidaknya keterlambatan atau kesalahan transfer dana tersebut, dalam hal ini teller atau nasabah pengirim diwajibkan untuk membuktikan. Teller harus segera memperbaiki kekeliruan tersebut dengan melakukan pembatalan. Teller yang terlambat melakukan perbaikan atas kekeliruan tersbut diwajibkan untuk membayar jasa, bunga, atau kompensasi. Teller bank harus mampu menjadi seorang pekerja yang teliti dalam menjalankan tugas dan fungsinya dengan menerapkan prinsip kehati-hatian agar tidak terjadi kesalahan dalam proses input transaksi transfer dana nasabah.
The process of funds transfer can be done in writing, and one of them is through a bank teller. This process of transferring funds does not always go well, sometimes problems arise regarding mistakes, and so on. Therefore, it is necessary to find a method of settlement of the incident, which is the core formulation of the problem in this study. This research is normative research. The results obtained from this study, namely bank tellers must be responsible for errors in the transfer of funds. In the event of a delay or error in transfer of funds, which then results in a loss to the Sender or Recipient, the organizer and/or other party controlling the fund transfer system is burdened with the obligation to prove whether or not there is a delay or error in transferring the teller or the sending customer is required to prove. The teller must immediately correct the mistake by making a cancellation. Tellers who are late in making repairs to the mistake are required to pay services, interest, or compensation. Bank tellers must be able to become a careful worker in carrying out their duties and functions by applying the precautionary principle so that there is no mistake in the input process of customer fund transfer transactions.
