PENERAPAN RESTORATIVE JUSTICE PADA TINGKAT PENUNTUTAN (STUDI KASUS DI KEJAKSAAN NEGERI KOTAMOBAGU)

Penerapan Restorative Justice pada tingkat Penuntutan terhadap tindak pidana penganiayaan di Kejaksaan Negeri Kotamobagu merupakan tahap paling efektif dalam menyelesaikan kasus yang adil bagi semua pihak. Pada tindak pidana Penganiayaan, kerapkali telah terjadi perdamaian antara pelaku dan korban namun dikarenakan berkas telah lengkap (P21) dan Penyidik telah melimpahkan Tersangka ke Kejaksaan (Penuntut Umum) maka perkara tersebut tidak dapat dihentikan, sehingga dalam hal ini Restorative Justice dinilai akan berperan signifikan dalam pelaksanaan supremasi hukum di Indonesia khususnya dalam penerapannya di tingkat Penuntutan. Penelitian yang berlokasi di Kejaksaan Negeri Kotamobagu ini menggunakan data primer dan sekunder sebagai sumber data rujukan dalam metode penelitian hukum empiris. Hasil penelitian ini menemukan bahwa Restorative Justice di Kejaksaan Negeri Kotamobagu dilaksanakan di tingkat penuntutan dalam penyelesaian tindak pidana penganiayaan Pasal 351 ayat (1) KUHP. Peraturan Jaksa Agung (Perja) Nomor 15 Tahun 2020 tentang Penghentian Penuntutan berdasarkan Restorative Justice pun telah benar dilaksanakan di Kejaksaan Negeri Kotamobagu namun masih ditemukan kendala yang diatur dalam Pasal 9 point 5 dalam Perja tersebut sehingga ada perkara yang telah diupayakan namun tidak berhasil dilaksanakan penghentian penuntutan sampai terbit SKP2 atau Surat Ketetapan Penghentian Penuntutan.
The application of Restorative Justice at the Prosecution level for criminal acts of persecution at the Kotamobagu District Attorney is the most effective stage in resolving cases that are fair for all parties. In the crime of torture, there is often peace between the perpetrator and the victim, but because the file is complete (P21) and the investigator has delegated the suspect to the Prosecutor’s Office (the General Prosecutor), the case cannot be stopped, so in this case Restorative Justice is considered to have a significant role in the implementation of book supremacy. in Indonesia, especially in its application at the Prosecution level. This research, which is located at the Kotamobagu District Attorney’s Office, uses primary and secondary data as a source of reference data in empirical legal research methods. The results of this study found that Restorative Justice at the Kotamobagu District Attorney’s Office was carried out at the prosecution level in the settlement of the Crime of Persecution Article 351 Paragraph (1) of the Criminal Code. The Attorney General’s Regulation (Perja) Number 15 of 2020 concerning Termination of Prosecution based on Restorative Justice has also been properly implemented at the Kotamobagu District Attorney but there are still obstacles as stipulated in Article 9 point 5 in the Perja so that there are cases that have been attempted but have not succeeded in terminating the prosecution, until the issuance of SKP2 or Decision Letter for Termination of Prosecution.
