ABSTRACT
Cosmetic products distributed in Indonesia are growing rapidly, resulting in the emergence of new cosmetic products being marketed to the public. The distribution of cosmetic products also requires a permit issued by the Food and Drug Supervisory Agency (BPOM), with the aim of ensuring safety, quality, and benefits for consumers who use them. This study examines the inconsistency in the application of administrative sanctions for revoking cosmetic distribution permits by BPOM due to promotions that violate moral norms based on PerBPOM No. 18 of 2024. This study uses a normative juridical research method with a statute approach and a conceptual approach to examine and analyze the applicable legal regulations related to the supervision and distribution permits for cosmetic products, as well as administrative law concepts, using legal principles for analysis. The main problem is that PerBPOM No. 18 of 2024 does not provide an explicit definition of moral norms, thus creating legal uncertainty. In addition, there are four significant inconsistencies in the application of sanctions: (1) BPOM applies direct revocation of distribution permits without a tiered process; (2) the principle of due process is not fulfilled; (3) there is inconsistency in the assessment of the severity of violations; and (4) there is a gap between normative provisions and implementation practices. These inconsistencies violate the principle of legal certainty and cause injustice to business actors. Regulatory reformulation with clear operational definitions and improvements to law enforcement mechanisms are needed to create a consistent, proportional, and fair marketing authorization revocation system.
